Powers and Duties of Guardian

The following Powers and Duties of the Guardian shall apply and form an integral part of this WILL.

1. Custody and Residence

  • Take physical and legal custody of the child(ren).
  • Provide safe, healthy living conditions.
  • Ensure the child lives in a morally and culturally appropriate environment.

2. Health and Medical Care

  • Make decisions regarding the child’s medical treatment and healthcare needs.
  • Authorize emergency procedures or surgeries if needed.

3. Education and Upbringing

  • Ensure proper education as per the child’s aptitude and interest.
  • Choose schools, colleges, or institutions that support the child’s growth.

4. Moral and Social Welfare

  • Guide the child in values, religion (as applicable), language, and traditions.
  • Provide social development and emotional support.

5. Custody of Bequeathed Assets

Act as a custodian of the bequeathed assets on behalf of the minors.

  • Use estate proceeds to pay for minors' well-being including residence, health and medical care, moral and social welfare, and anything that leads to the well-being of minors.
  • Hire attorneys, chartered accountants, real estate agents, or auditors for efficient administration of Estate.
  • Ensure that professional fees are reasonable and borne from the estate or shared among beneficiaries.
  • Get reimbursed for reasonable personal expenses incurred in maintaining the Estate.
