Powers and Duties of Executor

The following Powers and Duties of the Executor shall apply and form an integral part of this WILL.

1. Probate Application

  • Apply for probate in the competent district court or High Court (as per jurisdiction).
  • Submit original Will, death certificate, and other supporting documents.
  • Act under the court’s authority once probate is granted.

2. Preservation of Estate

  • Take immediate charge of the estate.
  • Secure movable and immovable assets.
  • Prevent theft, misuse, or dissipation of estate assets.

3. Inventory and Valuation

  • Prepare a complete inventory of the deceased's assets and liabilities.
  • Obtain valuation reports for real estate, jewelry, stocks, businesses, etc., from authorized valuers, as required.

4. Payment of Debts and Liabilities

Pay outstanding debts, EMIs, loans, utility bills, hospital charges, and credit card dues from the estate. Ensure tax compliance including:

  • Filing the final income tax return (ITR) of the deceased.
  • Paying inheritance tax (if applicable).
  • Responding to any tax authority notices.

5. Distribution of Assets to Beneficiaries

Distribute assets according to the Will, ensuring fair, legal, and timely allocation. Ensure that:

  • The beneficiaries receive title and possession of the assets.
  • Registration and mutation are done in their names (e.g., land records, shares).

6. Legal Proceedings

Represent the estate in legal proceedings, if any:

  • Defend challenges to the Will.
  • Claim monies owed to the deceased.
  • Settle claims by third parties.
